Do you believe law enforcement offices should be held responsible for setting free back into society illegal aliens who commit more serious and drastic crimes?

OREGON CITY — The family of a Texas girl murdered in 2007 is suing Clackamas County, claiming law enforcement officers knew her killer illegally entered the United States and failed to report him to immigration authorities.

The estate of Dani Countryman is seeking $3.5 million in damages, according to the Clackamas County Circuit Court filing.

Countryman, 15, died during a sexual assault July 28, 2007, after an all-night party at an Oak Grove apartment complex. She was in Oregon visiting relatives.

Edward S. McGlone III, assistant Clackamas County counsel, declined to comment on the complaint.

Alejandro Emeterio “Alex” Rivera Gamboa, 26, was sentenced to life in prison, with the possibility of parole after 35 years. He attempted to subdue Countryman, fatally choking her, as his cousin, Gilberto Javier “Gabe” Arellano Gamboa, tried to rape her.

Arellano Gamboa, 25, was sentenced to five years, 10 months in prison.

Both men were in the country illegally and will be deported to Mexico after serving their sentences.

The lawsuit claims that a Clackamas County probation officer and unnamed sheriff’s office employees failed to report Rivera Gamboa to the Immigration and Customs Enforcement.

The Oregonian reported that Rivera Gamboa pleaded guilty to drunken driving in November 2006. He signed a plea agreement that stated he was not a U.S. citizen and was released without anyone in the criminal justice system notifying immigration authorities.

    Yes. If the police know of a criminal activity and do not arrest the person, they are not doing their job. Allowing an illegal to purse her/his life here is the same as not arresting a drug dealer or burglar. Only pc cant has made the illegal somehow more acceptable in society. This much be changed and if it takes the threat of law suits to do, that’s the way it goes. I wish to point out that many police have tied hands on this matter due to corrupt local governments. Perhaps costly lawsuits will make those governments reconsider.

    The problem with ‘Illegal Immigrants’ is not the fault of the law enforcement offices. The problem was created in Washington D.C. by politicians, pro-amnesty bureaucrates, ACORN, ACLU, LaRaza, Democrates for cheap Hispanic votes, Republicans for cheap labor, liberal courts, sanctuary churches, sanctuary cities, sanctuary states and socialist in congress and in the administration.

    When they have to pay they will switch. State pensions are shaky at best. Judgments like these mean less retirement pay for cops and prosecutors. They understand that. Unfortunately, judges do too.

      yes, I hope this new trend becomes a tsunami legally. The family of the murdered man and son in SF, also filed a lawsuit this year.

    The lobbyists for the open border, the church, business consortium’s are deviously careful not to mention E-Verify, that discrepancies can be resolved at the Social Security agencies? Nor do they inform of the success rate of E-Verify, the fed immigration tool identifying illegal labor. These entities were nearly successful through the intervening Sen. Harry Reid (D-NV), with support from majority speaker Nancy Pelosi (D-CA) to crush the computer verification program. Unfortunately, E-Verify may become obsolete if they pass Comprehensive Immigration Reform, that will legitimize 20 to 30 million illegal immigrants? Plus it’s being kept in the dark, that millions more will pour across our undermanned border, or from across the world, once they get the word that AMNESTY is about to commence?

    We will be donating taxpayers dollars to support the poorest of families, with little or no education. Taxpayer will be paying for the old and sick person, mentally handicapped and those who need surgery who reaches American soil. It will be the–SAME– nightmare as the1986 immigration bill (IRCA) all over again, when 3 million materialized into 5.3 million and those working in agriculture disappeared, to enter the mainstream of US working class.
